Terms of Use

1. Purpose and acceptance

ARCO Legal (hereinafter, "the Platform") is a software-as-a-service that allows organizations to receive and manage personal data rights requests in accordance with Chile's Personal Data Protection Law 21719 (hereinafter, "the Law").

By accessing or using the Platform, the user declares that they have read, understood and fully accepted these Terms of Use. If you do not agree with any condition, you must refrain from using the service.

2. Service description

The Platform offers, among others, the following features:

• Branded public forms for ARCO request intake.
• Management and tracking panel for the full lifecycle of each request.
• Automatic deadline alerts (30 calendar days per Art. 11 of the Law).
• Auditable log and operation history.
• Multi-company management from a single account.

Available features depend on the contracted plan. ARCO Legal reserves the right to modify, expand or reduce features with prior notice.

3. Access and use conditions

Access to the Platform is reserved for individuals with full legal capacity or legal entities duly incorporated in Chile or abroad.

The user agrees to:

• Provide truthful and up-to-date information at the time of registration.
• Maintain the confidentiality of their access credentials.
• Not transfer or share their account with third parties.
• Use the Platform exclusively for lawful purposes and in accordance with the Law.
• Not attempt to access other users' accounts or breach system security.

The user is solely responsible for all actions carried out under their account.

4. Intellectual property

All elements of the Platform —including source code, visual design, logos, trademarks, texts and documentation— are the exclusive property of ARCO Legal or its licensors and are protected by Chilean and international intellectual property legislation.

Use of the Platform does not grant the user any intellectual property license beyond the limited, non-exclusive and revocable right to access the contracted service.

5. Limitation of liability

The Platform is provided "as is". ARCO Legal will make reasonable efforts to maintain service availability but does not warrant uninterrupted or error-free operation.

To the maximum extent permitted by Chilean law, ARCO Legal will not be liable for indirect, incidental, special or consequential damages (including loss of data or business) arising from the use or inability to use the Platform. ARCO Legal's total cumulative liability will not exceed the amount paid by the user in the last twelve (12) months.

6. Changes to the Terms

ARCO Legal may modify these Terms at any time. We will notify relevant changes by email or in the Platform with at least 15 days' notice. Modifications will take effect on the date indicated in the notice.

Continued use of the Platform after the new Terms take effect implies acceptance. If the user does not accept the modifications, they must stop using the service and notify hola@arco.legal.

7. Term and termination

These Terms govern from the date of acceptance until either party terminates the contractual relationship. ARCO Legal may suspend or terminate access to the Platform with cause, including breach of these Terms, with at least 5 business days' notice, except in cases of serious infringement justifying immediate termination.

Upon termination, the user may export their data within the following 30 days. After that period, ARCO Legal may delete the data in accordance with its Privacy Policy.

8. Governing law and jurisdiction

These Terms of Use are governed by the laws of the Republic of Chile. Any dispute arising from their interpretation or execution will be submitted to the jurisdiction of the Ordinary Courts of Justice of the city of Santiago, Chile, the parties waiving any other jurisdiction that may apply.
